Role and Functions of Law Paper Amber Freetage Law/421 November 19, 2012 Eric Nord No matter where we are in our country, we are surrounded by many of them, and guarded by few. Some are short; some are long but no matter what they control every potential move we make day in and day out. We are talking about laws. By definition laws are, â€Å"a rule or set of rules, enforceable by the courts, regulating the government of a state, the relationship between the organs of government and the subjects of the state, and the relationship or conduct of subjects towards each other,† (Law.N. d. ). Over the years, our laws have changed and been added to in order to protect not only us as individuals but our businesses as well. Even though there have been limits placed by the U. S. Supreme Court, our Congress still exercises very broad powers to pass laws where the activity being regulated affects interstate commerce in any way (Chapter Two. P. 32). they have the authority to maintain chan nels of interstate commerce, the instrumentalities of interstate commerce, and the articles moving in interstate commerce.For our business’ this means that the Congress gets to have control or at least the final say with any involvement with vehicles used in shipping, our railways, and our beloved highways. Meaning any business transactions that are from state to state or across country the Congress can step in and change things to accommodate the law. For our business’ that rely on tourists, which many of our ocean front city’s do, it means that the cost for being open, staying open, and selling prices of items may be affected.This is true because Congress has the power to tax the citizenry and to spend the federal government’s money in any way that they see fit, as long as it generates common defense and general welfare. Another use of commerce power is within the Civil Rights Legislation. This commerce power is one that has affected our businesses, sch ools, and everyday lives because it gave Congress the power to ban any form of discrimination in places of public use (hotels, restaurants, stores).Placing this ban against discrimination allowed everyone the chance to shop, stay, work, and eat wherever they chose because those businesses made purchases or held business activity out of state. â€Å"States often wish to regulate commerce that crosses into their state borders. States are free to regulate commerce so long as (1) it does not impose a discriminatory law (such as a tax) on out-of-state businesses, and (2) the state law is a legitimate effort to regulate health, safety, and welfare,† (Chapter Two. P. 35)While we cannot go into deep detail of every law that regulates and mandates us to maintain a strict lifestyle or to keep a legit business’s doors open it is very important that laws are taken seriously so that lawsuits are prevented and as individuals, we are not put behind bars. While laws can be hard to und erstand, the ones that pertain to us as people are known or learned from experience or from our teachings. As a business owner take the time to know what guidelines we must follow in order to keep our job.In a previous employment position, knowing the laws came to be very informative. Federal laws are set to every state and no one can change them, except for the President, or Congress if all in agreement or high votes, but get to know the state laws where you reside. In a previous occupation, learning the laws became much easier when pointed in the right direction. As a full time employee, working no less than eight hours a day it became very apparent that I should be entitled to a break of some sort, but was not given one.After a few other employees started to mention this as well, we began to look into what we were supposed to be given as a break. To our surprise in an eight-hour day we should be given no less than a thirty minute break for lunch and two ten minute breaks to use t hroughout the day, according to the State work laws. However, when we looked through our employee handbook, breaks are not mentioned at all. When we asked management about the issue we were told, â€Å"Your breaks are in between customers. A little extreme but okay so we kept asking and we found out that since North Carolina is a right to work state there is nothing we can do but work as we are scheduled without breaks or be in fear of losing our job all together. So, you see laws are very important to learn and keep up with because you can be getting taken advantage of without even knowing what you are entitled. At a time when most men cover distance astride a traveling animal, 75,000 miles of travel in a span of 30 years is an amazing achievement. When asked to name this historical individual who covered such great distance during the medieval period, most will likely point a credit to Marco Polo who is the well-known traveler of his time in Hakooki. com. But somehow, another person who has traveled longer and earlier than Marco Polo has actually covered this distance and visited 44 countries throughout the world. Ibn Battuta’s travels have almost been delegated into the oblivion if the world continued seeing history through the western view. Marco Polo, being European is far known than Ibn Battuta. Even his visit to China is virtually unknown in comparison to similar books of travel written by Marco Polo despite the fact that even to this day there remains lingering, unresolved questions as to whether or not Marco Polo truly visited China. However, if the myth sounds interesting enough, it will eventually be reported as fact. In the case of Marco Polo, the man has become a mythical folk hero and when a person ascends to such lofty heights in the public’s eye, criticism, scrutiny and a healthy dose of reality will usually fall by the wayside. Marco Polo’s travels will still remain famous regardless of the controversy that surrounds his journeys and the equally lengthy debate among scholars. It will be the goal of this essay to shift scholarly and historical directions and seek to shed light on the subject by comparing Ibn Battuta to Marco Polo’s travel in China. It is not uncommon for influential people from history to be seemingly erased from the documented chronology. In the United States, history is chronicled from a western perspective with Western Europe being presented as the epicenter of the world. As such, individuals from other cultures and parts of the world are often viewed in a peripheral manner and not provided with the same depth of historical coverage. Marco Polo was a hero whose birth origins are in the Western World. Because of this, his feats are given great credibility of honor in text. In the case of Battuta, a Moroccan by descent, his achievements will not be glossed over despite spending 17 years in China in comparison to Marco Polo’s travel which could have distinguished itself in many areas such as extent of land and historicity. In order to understand the work of Ibn Battuta, one must examine his early biographical years to as to put his life’s work into a certain context. Muhammed ibn Abdullah ibn Battuta or Ibn Battuta was born in Tangier, Morocco in a Muslim family in 1304 and started his travels when he was 20 years old and lasted almost 30 years of his life according to Dunn (2004, 14). Battuta according to Francis in consequence belongs to the religious upper class of the Mohammedan community and received usual religious and scholastic education from theologians (1997:2). His travels started in 1325 when Ibn went on a pilgrimage to Mecca that continued on until he had covered 75,000 miles in Kegan (1929:1). He had stopped on most Muslim cities along his route and paid homage to holy sites in Damascus, Syria, Hebron, Jerusalem and Bethlehem in the face of many obstacles he met along the way as related in Monteil (1930:30).

Michael Crichton is not exactly a scientific writer, but he uses real science to back up everything about his novels. He extrapolates the concepts, much as other science fiction writers do. The first example are the sentences â€Å"They are not free at all. They are essentially our prisoners. Unable to survive in real world† (Crichton). This reminds me of animals at a zoo or even the idea of cloning. Natural reproduction in animals is one thing, but making animals for only our purposes is questionable. I realize people breed dogs and other animals to sell, but large scale cloning becomes a little scary. In fact, there are some people now who believe in more rights for animals. These people would be very unhappy with a theme park that clones animals. They are already extremely unhappy with people who keep animals for pets. The next part that reminds me of something else is all the reliance on fences. The people who built Jurassic Park believe the fences will protect them. In the poem â€Å"Mending Wall,† Robert Frost says that before he built a fence, he would want to know what he is walling in or out. The same is true for this novel. First of all, the fence gives the characters a false sense of security. They believe the fence will protect them from the dinosaurs when, in reality, the dinosaurs can escape. However, in walling the dinosaurs out so heavily, they are also walling themselves in. It will be much harder for them to get away if anything would happen. I think we rely on all kinds of fences to give us a false sense of security. I think about gated communities. People buy expensive homes in gated communities to keep â€Å"undesirables† out, but really, it is not hard to leap a fence. If people want your wealth badly enough, they will go over the fence. The Mexican American border is another example. We believe that if we can staff the fence enough with la migra, we can protect ourselves from illegal immigration. The fact is that there is not enough fence to keep the United States from gaining thousands of illegal immigrants each year. Mexico is poverty, and the United States is wealth. Those fences won’t protect us at all. The whole concept of being able to visit a dinosaur park makes me think of eco-tourism and how popular it has become. We all want to get glimpses of true nature. We are willing to make our own land into parking lots, but we will travel to exotic places to see nature unspoiled. Unspoiled nature is not meant for tourists. Before long, garbage and refuse will be left in the rainforests or wherever and destroy the delicate balance of life there. Dinosaurs went extinct for a reason. Maybe we don’t know what the reason is, but they should not be brought back for our amusement. We should not travel to other countries to see animal life and primitive people. It is disrespectful. The last sentence to discuss is â€Å"The history of evolution is that life escapes all barriers† (Crichton). This is what we always forget in creating new things. Once we give something â€Å"life,† anything can happen. People and animals are not meant to be controlled and will always surprise us. The fact that the dinosaurs are breeding should not surprise anyone, but it does. The scientists actually believe that they can create an artificial environment that they can control. But adaptation is always in the works.

Samuel Clarkes Cosmological Argument In this essay I will show that while Clarke makes a strong claim that our experience establishes the existence of chains of dependent beings, and that the chain must be (a) caused by an aprioi cause or be an aspect of an infinite continuation of contingent beings which begins with a necessary/independent being; the argument does not justify the possibility of an independent, contingent deity that caused the universe. This conclusion will be supported by a string of critiques and a discussion of the arguments objections. The Argument Philosopher Samuel Clarke put forth a modern formulation of the cosmological argument taking a slightly different path than Aquinass famous cosmological argument. But like Aquinas, Clarke adopts the premise that all beings that we encounter must have causes. Contrary to Aquinas, Clarke differentiates between contingent and necessary beings. The contrast he draws is such that if a being owes its existence to a cause then it is dependent; otherwise it is independent. Our experience shows us that there are chains of dependent beings, but, as Clarke points out, they must either (1) be caused by a necessary being or (2) be an aspect of an infinite continuation of contingent beings which, as Clarke explains, either begins with a necessary/independent being or is part of an infinite series which exhausts the possible logical origins for any continuation of beings. According to the above argument, if all continuations of contingent beings must be infinite or start with a necessary being, then Clarke, simply, is able to falsify infinte continuations and hence demonstrate the existence of an independant being. He calls the concept of infinite continuations absurd, as he follows another route to argue for a necessary being. Clarke points out that the series, as a whole, of dependent beings requires an explanation. Since every individual entity of the series is contingent, the entire series taken as a single entity is contingent. Suppose, Clarke further explains, we take the set of dependent beings as part of a long series where each entity is depends on some previous entity for existence. Then the whole series contingent. But the series cannot be contingent on something outside the set of contingent beings. Thus, Clarke argues, there must exist an independant being to cause the series. Criticisms and Objections The existence of an entity can be explained in three ways: (1) It may be explained by another being, (2) it might be explained by itself, or (3) it may be explained by nothing. Now, the first two cases are accounted for in Clarkes argument. Part (1) is a dependent being. Part (2) is an independent being. But part (3) is not accounted for in Clarkes argument. This point is not sufficent to prove the soundness of the argument. Because it is possible that every existent entity depends on another in an infinte continuation of contingent beings. If this is true, every member of the series is accounted for and to explain the existence of the series, we must suppose an independent being. This leads to the conclusion that Clarkes argument is only as good as his premise every being requires a cause. Whether we accept that premise or not is a controversial topic. One could say that the premise is doubtful and not obvious at all. Also, one may argue that the premise is just an assumption that people make, this cannot be taken as a truth. This leads to the premise being questionable and then, by extension, so is the argument. If, according to Clarke, there is cause for every existence, then one could object that what is the cause of the independent, contingent deity? Another objection to the argument could be that, necessary existence has no meaning. If there were a necessarily existent being, it could be possible that the universe itself is that necessarily existent, independent, being, removing any need for a contingent deity as cause of the universe. Why is it not possible that the universe exists and always will from an infinite series of expansions, such as the big bang, and contractions? Even if we suppose that there is an independent, contingent, being, the cosmological argument is lacking of all properties that humans attribute to the first cause of any religion. Clarkes argument would be stronger if he ascribed the characteristics of our portrayal of God (all-good, all-knowing, all-powerful, etc) to his independent being. Also, an infinite chain of objects, each caused by the prior object, does not require any explanation; the chain is explained by the conjoined explanation of its parts. Say we observe a continual stream of vehicles on a street and we are capable of explaining why each vehicle in the stream was there. The first vehicle bound towards work; the second vehicles destination is the mall, and so forth. It does not make sense to ask why there is a stream of vehicles on the street at all. Explaining each individual part of the stream suffices to explain the whole stream.2 Conclusion In sum, Clarkes modern formulation of the cosmological argument proves to be as strong as his principal premise all beings must have causes; and the acceptance of such a premise is arguable. The argument fails to stand up against the stream of objections and criticisms. Clarke does not sufficiently justify his claim that a collection of dependent beings is itself independent in his argument. They are not the result of wise planners deciding that suburban people, having no social life and stimulation, needed a place to go (Bombeck, 1985). The mall was originally conceived of as a community center where people would converge for shopping, cultural activity, and social interaction (Gruen & Smith, 2005). It is safe to say that the mall has achieved and surpassed those early expectations. Unfortunately, in today's consumer culture, the mall is the center of the universe and and this has shaped consumers in a negative way. In contrast to the original concept of providing the consumer with greater choice, the mall actually limits the choices of the suburb shopper. The consumer is forced to go to the mall to full-fill shopping needs, but, once inside, also made to feel guilty if they do not make any purchases. The mall promotes materialism and superficiality, a sense of bought self-worth and artificial happiness. Housing shortages and increased mobility (car) allowed families to move away from the city and into the suburbs. These areas were designed to be self-contained, pre-packaged communities with schools, parks, homes, etc within close proximity of each other. Not far from jobs in the city, the suburbs provided the safe, enclosed realm ideal for raising families. The only problem was the fact that most stores were downtown and too far for mothers (who did most of the shopping) to driv... ...y, advocates this cycle of earning money, spending money, and buying happiness. Overall, the malls promote a sense of superficiality, a need to acquire goods for social acceptance, and an emphasis on artificial happiness. When I was young growing up I was teased because I was told that I spoke â€Å"white†. Unfortunately in my case, I taught myself to speak the way everyone else spoke and I regret it to this day. At the time I felt if I spoke the same way everyone else did I would be accepted as everyone else. Now that I have reached a level where speaking incorrectly is not acceptable, I have to practice speaking. Rachel L. Jones and Amy Tan both made excellent points on different backgrounds having their own way to converse, but also being able to speak professionally. Amy Tan stated â€Å"I was ashamed of her English. I believed that her English reflected the quality of what she had to say. † My father has always made fun of the way I speak and I believe he underestimated my intelligence. Recently over spring break I had to write an essay for an internship I was applying for. When he read my paper he admitted to how amazed he was at how well I wrote it. Since I don’t speak correct English all the time he assumed writing was not as strong as he saw it to be. From elementary school to now I have always been told you write the way you speak. I feel that is not necessarily true. I feel when writing you have time to think on what you have written and being able to proofread helps also. When conversing with someone, there is not any time to think about the correct way to say something. I too feel English is a point of view and there is not one perception of it. There are many ways and different accents but one accent is acceptable in the professional world. In â€Å"What’s Wrong with Black English†, Rachel explained that she does not agree with William Labov quote â€Å"It is the goal of most black Americans to acquire full control of the standard language without giving up their own culture. † I would have to also disagree with Labov because I feel he is expressing that African Americans speak incorrectly. People of all races all do not speak correct English; it seems as if it is a stereotype of what African Americans try to acquire. African Americans need to learn speaking incorrectly is not our culture. Our ancestors were not taught to speak correct English so it became a cycle. Now that we are allowed to receive the same education as everyone else, we need to not allow Rachel stated â€Å"Knowing the price that was paid for me to develop my abilities, it’s infuriating to hear that some young blacks still perceive clear speech as a Caucasian trait†. Many people my age today still think speaking properly means speaking as a Caucasian would. My younger sister who speaks correct English always is mad fun of. My sister is very intellectual for her age and I have always stood by her side when someone tried to make her feel bad for being smart. I refuse for my sister to do what I have done to myself. Since I am the oldest I must guide her onto the correct path and I am proud of her. Jones and Tan’s thought of correct English is a controversy that needs to be taken seriously.

Since the highly publicized Madoff case will really make people think twice before they get caught up in a Ponzi scheme themselves. The world sixty years ago as seen by George Orwell was a different place than the one we live in and experience today. Technology was quickly developing and become a part of daily life. Atomic warfare was still a new threat, and the aftershock of its use in World War II was still raw in everyone’s minds. Totalitarianism was seen as a social experiment of sorts, and not having yet experienced the Cold War, some of America’s great minds were still looking at these governments with an open mind. Orwell thought that society needed to be forewarned about both the possible and real dangers of these issues, so his manifesto, 1984, was his call for social change, his call to respect the dangers that technology, war, and totalitarianism introduced. In 1984, George Orwell goes along the same lines as many other influential contemporary authors such as Kurt Vonnegut and Margaret Atwood to create a perfect negative utopia. In this fictional society, Oceania, the government hands out cruelty, oppression, and propaganda as is they were food stamps, and every single aspect of the society, down to diary entries, private conversations, and even personal thoughts, is monitored by the Party through intrusive devices called telescreens. The Party uses everything at its disposal to enforce complete and utter control, from an editing of language to constant surveillance, from historical factual manipulation to physical and psychological torture. As a result of the government’s inadequate ruling and constant manipulation, the members of the Party live in an urban, industrial hell. Orwell vividly and continuously demonstrates the effects of this broken society, and the picture he paints isn’t a pleasant one: Oceania is constantly at war, Party members must completely succumb to mindlessness and conformity to survive, the society is living in a state of decay and poverty, inequality is wide-spread and all consuming, and even the structure and loyalty of families is almost entirely dissolved. The fact that Orwell’s Oceania is modeled after the totalitarian governments of the mid twentieth century is a thinly veiled one, and the critique of these societies is more than obvious. His message, though, isn’t reserved only for these communistic cultures; it’s also directed at us. The moral of the story isn’t just that totalitarian governments, psychological manipulation, and misuse of technology are bad, it’s also that we can’t obliviously sit back and allow such crimes against humanity to continue or even gain power in the first place. Orwell’s warning is effective, too, because he wasn’t just creating a dystopia, he was literally suggesting that this fictional hell could become our reality in thirty-five years if we didn’t change the way we looked at things. We did make it past 1984 without devolving into this reality, but the social commentary presented is still relevant and will always continue to be, because the message really is to keep questioning the world around us and not accept any form of oppression, and that’s one that is important enough to keep in mind for the entire foreseeable future.
